Lyca Mobile has petitioned the FCC to protect competition in the MVNO market, accusing T-Mobile of using its market dominance post-mergers with Sprint and Mint Mobile to undermine rivals.
Lyca claims T-Mobile’s actions, such as delaying functionalities and misrepresenting data usage, violate DOJ conditions from the 2020 Sprint merger.
T-Mobile’s sued to terminate Lycamobile in 2022, despite DOJ mandates to maintain MVNO agreements, highlights anti-competitive behavior.
“T-Mobile’s behavior following its merger with Sprint Corporation, and following its recent acquisition of Mint Mobile … violates: (1) its obligations to protect MVNOs as set forth in the Department of Justice Final Judgment; and (2) the FCC’s Order approving the [Mint] transaction,” Lyca attorneys wrote in a May 17 recent recap of the company’s meeting with FCC officials.
Lyca urges the DOJ and FCC to investigate T-Mobile’s compliance and competitive practices to ensure fair market conditions.
“Economic analysis supports the conclusion that T-Mobile is subverting a key purpose of the Final Order — to preserve, if not enhance, MVNO competition,” Lyca wrote.
